General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through the online store of Drive Hunt GbR by consumers and businesses. The version applicable at the time the order is placed shall apply.

2. Contract Formation

The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order.

By submitting an order, you make a binding offer to purchase the goods contained in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email.

3. Prices and Payment

All prices are stated in EUR. We apply the small business regulation pursuant to § 19 UStG (German VAT Act). Therefore, VAT is not charged or shown separately.

The available payment methods are displayed during checkout. Unless otherwise stated for the selected payment method, payment is due upon conclusion of the contract.

4. Delivery

Delivery is made to the delivery address provided during the ordering process. Available delivery options, delivery times and shipping costs are displayed in the online store or during checkout.

5. Right of Withdrawal

Consumers have the statutory right of withdrawal where applicable. Details regarding the right of withdrawal, deadlines, returns and return costs can be found in our Refund Policy.

6. Statutory Rights in Case of Defects

The statutory rights regarding defective goods apply. These statutory rights are not restricted by these General Terms and Conditions.

7. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, as well as for damages resulting from injury to life, body or health.

In cases of slight negligence, we are liable only for the breach of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the contractual partner may regularly rely. In such cases, liability is limited to the foreseeable damage typical for the contract.

Mandatory statutory liability remains unaffected.

8. Governing Law

The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

9. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
